Terms of Use

1. Who we are

KESPA AI is a project and service operated by NexLabs Studio LLC, doing business as NexLabs Studio (“NexLabs,” “we,” “us,” or “our”).

2. Registration and access

You must provide accurate account information and use the service only through accounts you are authorized to control. KESPA may allow sign-in using email/password, Google, Discord, or other methods we make available. If you create a password, you are responsible for keeping it confidential and must not share verification or recovery codes.

You are responsible for activity under your account and for keeping any authentication factors, recovery codes, API credentials, and connected accounts secure.

The service is not directed to children under 13. If you are under the age of legal majority where you live, you may use KESPA only with permission from a parent or legal guardian and where permitted by applicable law.

3. Using KESPA

You may use KESPA only in compliance with applicable law and these Terms. You may not:

• use the service to violate another person’s rights or applicable law;
• attempt to gain unauthorized access to accounts, systems, data, models, or infrastructure;
• interfere with or disrupt the service, security controls, rate limits, or abuse-prevention systems;
• upload malware or content you do not have the right to provide;
• misrepresent AI-generated output as authoritative when independent verification is required;
• reverse engineer protected portions of the service except where applicable law expressly permits it.

4. Your content and data

As between you and NexLabs, you retain your rights in the prompts, files, records, data, and other material you submit to KESPA (“Input”), subject to rights held by others.

You grant NexLabs the limited rights necessary to host, process, transmit, analyze, secure, back up, and otherwise handle Input to provide and maintain KESPA, subject to our Privacy Policy and your applicable settings.

You are responsible for ensuring you have the rights and permissions necessary to submit Input, including personal information belonging to other people.

Private user content is not automatically made public or added to the public KESPA research repository. Public research releases use a separate review and sanitization process.

5. AI outputs and accuracy

KESPA uses automated systems, including language and multimodal models. Outputs may be inaccurate, incomplete, outdated, or unsuitable for your purpose.

You are responsible for reviewing outputs before relying on them, especially for legal, medical, financial, employment, safety, or other high-impact decisions.

Generated answers are not automatically treated as verified knowledge merely because a model produced them.

6. Open Beta services

Beta functionality is provided for evaluation and testing. During the Open Beta, we may change models, routing, storage formats, quotas, interfaces, providers, or experimental features without guaranteeing backwards compatibility.

We may need to repair, migrate, or reset beta-only state when technically necessary. Where personal information is involved, we will handle it subject to the Privacy Policy and applicable law.

7. Third-party services

KESPA may interoperate with third-party services such as Google, Discord, payment processors, hosting/infrastructure providers, communication providers, or optional external AI providers. Their services are governed by their own terms and privacy practices.

We are not responsible for third-party services that you choose to use, except to the extent required by applicable law.

8. Paid features, plans, and contributions

If KESPA offers paid subscriptions, usage-based charges, support packages, or other paid features, prices and material billing terms will be shown before purchase. Payment processing may be performed by a third-party processor.

Unless expressly described as a charitable donation, contributions to KESPA or NexLabs are not represented as tax-deductible charitable donations.

9. Suspension and termination

We may suspend or restrict access when reasonably necessary to protect users, infrastructure, security, legal compliance, or the integrity of the Open Beta, including for abuse or material violation of these Terms.

You may stop using KESPA at any time. Requests concerning deletion of personal information are handled as described in the Privacy Policy.

10. Disclaimers

KESPA IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL ALWAYS BE ACCURATE OR COMPLETE.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by applicable law, NexLabs Studio LLC and its members, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of KESPA.

Nothing in these Terms limits liability that cannot legally be limited or excluded. Consumer rights that apply in your jurisdiction remain unaffected.

12. Changes to these Terms

We may update these Terms as KESPA changes or as legal requirements evolve. We will update the effective date and version when we do. If a change is material, we may provide additional notice through the service or another reasonable method.
